La situació de la dona dins el sistema penitenciari des d’una perspectiva de gènere

[cat] Històricament, la dona ha patit una sèrie de discriminacions, creades i basades en el seu gènere, que l’han situat en desigualtat d’oportunitats i condicions en comparació a l’home. Aquestes discriminacions s’han perpetuat des de diferents àmbits i sectors socials, com ara el mercat laboral o el sistema educatiu, a través dels diferents agents socials, com ara la família, la comunitat, l’escola o els mitjans de comunicació. És entre aquests agents i sectors socials on es troba el sistema penitenciari: és també aquest un agent discriminador de gènere? S’ha realitzat una revisió sistemàtica de la literatura relacionada amb la temàtica de treball, que ha estat complementada amb la realització de dues entrevistes a dues persones professionals del Centre Penitenciari de Mallorca i una observació directa del mòdul de dones del mateix. Així doncs, un total de 18 documents localitzats a la revisió sistemàtica es veuen complementats per la informació obtinguda al treball de camp. Els resultats confirmen la figura del sistema penitenciari com un agent perpetuador de discriminacions al sector femení de la societat tant de caire formal, com les lleis i normativa penitenciaria, com de caire subjectiu, com els estigmes sobre la dona delinqüent o les sancions imposades en comparació als seus companys homes.

[eng] Historically, women have suffered a series of discriminations, created and based on their gender, which have placed them inequality of opportunities and conditions compared to man. These discriminations have been perpetuated from different fields and social sectors, such as the labor market or the educative system, through different social agents, such as the family, the community, the school or the media. It is among these social sectors and agents where the prison system is: is it also a gender discrimination agent? A systematic revision of the literature related to the subject of work has been carried out, which has been complemented with the realization of two interviews with two professionals from the Penitentiary Center of Mallorca and a direct observation of the module of women of the same. Thus, a total of 18 documents located in the systematic review are complemented by the information obtained in the fieldwork. The results confirm the figure of the penitentiary system as a perpetuating agent of discrimination in the female sector of the company both formal, as well as the laws and penitentiary regulations, as subjective, such as the stigmas on the delinquent woman or the sanctions imposed in comparison to his fellow men.
