Stalking. Anàlisi d'un nouvingut al Codi Penal

[cat] Aquest treball intentarà analitzar el Stalking, introduït ja fa més de 5 anys en l'article 172 ter del Codi Penal fins a aquest moment havíem d'acomodar aquest tipus penal com a amenaces i fins i tot coaccions el que comportava moltes vegades al fet que algunes situacions delictives no quedessin prou castigades. Amb la nova tipificació es persegueixen les conductes per part de tercers que alterin de manera reiterada i persistent a la víctima, havent aquesta ultima de modificar el seu modus vivendi. Amb aquest treball intentaré aportar el que suposa el fenomen del Stalking en el ordenament jurídic i també em centraré en constatar la introducció del Stalking en altres països europeus. Estem davant un treball sobre un Delicte que per desgracia a Espanya encara no hi ha molta informació publicada, a penes existeix informació i estudis publicats. El que ha suposat un ingent treball de recopilació de tot el publicat a Espanya en aquests últims anys i a altres països que he pogut aconseguir, segur que m'hauré deixat molta informació i molts autors però crec que l'aconseguit servirà per a donar llum.

[eng] This paper will attempt to analyse stalking, which was introduced more than 5 years ago in article 172 ter of the Criminal Code. Until now, we have had to accommodate this criminal offence as threats and even coercion, which often led to the fact that some criminal situations were not sufficiently punished. With the new criminalisation, we are pursuing conduct on the part of third parties who repeatedly and persistently alter the victim, with the latter having to modify his or her way of life. With this work I will try to contribute what the phenomenon of Stalking entails in the legal system, and I will also focus on the introduction of Stalking in other European countries. This is a work on a crime that unfortunately in Spain there is still not much information published, although there is hardly any information or studies published. It has been a huge task to compile all that has been published in Spain in recent years and in other countries that I have been able to find. I am sure that I have left out a lot of information and many authors, but I believe that what I have found will serve to shed light on the subject
