El informe pericial psicológico en la sentencia judicial

[spa] Una de las principales funciones de la Psicología Forense es la de auxiliar al/la juez en su toma de decisiones. Tal es así, que el informe pericial psicológico constituye un medio de prueba en el que se exponen todas las actuaciones metodológicas practicadas y las conclusiones que de ellas se derivan a fin de dar adecuada respuesta a la/s pregunta/s formulada/s. (Borrás, 2021; Echeburúa et. al., 2011) En el presente trabajo, a fin de conocer la importancia otorgada al informe pericial psicológico por parte del juzgador, se analizan 30 sentencias dictadas por la Audiencia Provincial de las Islas Baleares entre 2017 y 2022: 10 relativas al ámbito civil (guarda y custodia) y 20 al ámbito penal (10 sobre delitos de abuso contra la libertad e indemnidad sexual y 10 relativas a malos tratos en el ámbito doméstico).

[eng] One of the main functions of Forensic Psychology is to assist the judge in his decision-making. Such is the case, that the psychological expert report constitutes a means of proof in which all the methodological actions carried out and the conclusions derived from them are exhibited in order to give an adequate answer to the question/s raised. (Borrás, 2021; Echeburúa et. al., 2011) In this project, in order to know the importance given by the judge to the psychological expert report, 30 sentences issued by the Provincial Court of the Balearic Islands between 2017 and 2022 are analyzed: 10 related to the civil field (guardianship and custody) and 20 to the criminal field (10 on crimes of abuse against sexual freedom and indemnity and 10 related to abuse in the domestic sphere).
