La responsabilidad de los sujetos de la actividad turística

[spa] Este Trabajo de Fin de Grado, en adelante TFG, aborda un estudio sobre la responsabilidad en los sujetos en la actividad turística. La información plasmada en el TFG incide en los tipos de responsabilidades y en la Directiva (UE) 2015/2302 que es por la que se rigen y que el Real Decreto 23/2018 la transpone. Asimismo, este proyecto aborda el desarrollo del concepto de contrato y contrato turístico. Así como, el contrato de viaje combinado, servicios de viaje vinculados y servicios sueltos. Haciendo hincapié, en los usuarios o consumidores denominados viajeros según la ley del viaje combinado. En el momento en que la falta de cumplimiento ante lo contratado, genera situaciones de responsabilidad por parte del organizador o detallista. Es decir, cuando el consumidor de manera genérica pretende obtener responsabilidad por daños y perjuicios, como compensación se genera indemnización, debido a la falta de cumplimiento de obligaciones por parte del organizador o detallista hacia el usuario o consumidor.

[cat] This Final Degree Project, hereinafter TFG, has been carried out through an analysis on the responsibility of the subjects in the hospitality industry. The information highlighted the TFG affects the types of contractual responsibilities and the legal act of the European Union known as Directive 2015/2302, which is the tool that legally binding them. In addition, this project addresses the development of the concept of contract and tourism contract. As well as different types of contracts such as: Package travel, Dynamic packages and individual services. By establishing this, and exercising in the users or consumers called travelers of the Package travel when it is not possible to contract what type of claim is attachable, situations and assumptions of non-compliance are generated due to the lack of fulfillment of the responsibilities and duties of the organizer or retailer. In other words, when the consumer, in a generic way, intends to obtain responsibility for damages, as compensation a contractual compensation is born as a differential action to resolve by law.
