El despido disciplinario durante la incapacidad laboral

[spa] En este Trabajo de Final de Grado he querido contemplar la incapacidad temporal como motivo o no, en sus diferentes perspectivas, del despido disciplinario y los distintos puntos que se deben tener en cuenta tanto por el trabajador como por el empresario que no esté de acuerdo en el mantenimiento de esta situación por no creerla ajustada a derecho. El objetivo ha sido poner de manifiesto las peculiaridades que se asocian a la relación laboral a la hora de que el trabajador comience una situación de incapacidad laboral, exponiendo los diferentes motivos que pueden mediar en la misma.

[eng] In this Final Degree Thesis, I wanted to contemplate the temporary disability as a reason or not, in its different perspectives, of the disciplinary dismissal and the different points that must be taken into account both by the worker and the employer who does not agree with the maintenance of this situation for not believing it to be in accordance with the law. The objective has been to highlight the peculiarities associated with the employment relationship when the worker begins a situation of incapacity for work, exposing the different reasons that can mediate in the same.
