Una aproximación a la configuración constitucional del Consejo General Del Poder Judicial, con especial antención a su función disciplinaria

Abstract

[spa] El presente trabajo realiza un acercamiento al Consejo General del Poder judicial y a la facultad disciplinaria que desarrolla. Se estructura en dos grandes partes: en la primera, se realiza una aproximación de carácter global al Consejo General del Poder Judicial exponiendo sus características; antecedentes históricos; las atribuciones que tiene encomendadas durante su mandato (clasificándose las mismas) y las atribuciones encomendadas cuando se encuentra en funciones al expirar dicho mandato y no haberse procedido a su renovación; los órganos que lo componen (Pleno, distintas Comisiones, órganos técnicos…). En la segunda parte, se analiza la función disciplinaria que realiza el Consejo. Dicho análisis engloba áreas como la responsabilidad de Jueces y Magistrados; los principios que rigen el régimen disciplinario, qué dispone sobre el mismo la LOPJ (calificación y tipos de sanciones, procedimiento que se sigue…); la inspección de Juzgados y Tribunales y la figura de la Comisión Disciplinaria y del Promotor de la Acción Disciplinaria (creado en la reforma de la LOPJ de 2013).

[eng] This Final Degree Project provides an approach to the General Council of the Judiciary and the disciplinary powers it exercises. It is structured in two main parts: in the first part, a global approach is made to the General Council of the Judiciary, setting out its characteristics; historical background; the powers entrusted to it during its mandate (classifying them) and the powers entrusted to it when it is in office on expiry of its mandate and has not been renewed; the bodies that comprise it (Plenary, different Commissions, technical bodies, etc.). The second part analyses the disciplinary function performed by the Council. This analysis covers areas such as the responsibility of Judges and Magistrates; the principles governing the disciplinary regime, what the LOPJ has to say about it (qualification and types of sanctions, procedure followed...); the inspection of Courts and Tribunals and the figure of the Disciplinary Commission and the Promoter of Disciplinary Action (created in the reform of the LOPJ in 2013).
