La voluntariedad del trabajo a distancia y su carácter reversible

[spa] Este capítulo trata el carácter voluntario y reversible del trabajo a distancia, tanto para el empresario como para el trabajador. El asunto viene inicialmente regulado en el artículo 5 del Real Decreto-Ley 28/2020, de 22 de septiembre, de trabajo a distancia. Su primer apartado delimita los términos de esta voluntariedad; el segundo pretende blindar el ejercicio de la voluntariedad y/o la decisión de revertir el régimen de trabajo a distancia; y el tercero, en fin, establece el régimen jurídico del carácter reversible del propio trabajo a distancia.

[cat] Aquest capítol tracta sobre la naturalesa voluntària i reversible del treball a distància per tant l'empleador com el treballador. Aquest tema està inicialment regulat a l'article 5 del Reial Decret-Llei 28/2020, de 22 de setembre, sobre treball a distància. El primer apartat delimita els termes de la voluntarietat; el segon busca garantir l'exercici d'aquesta voluntarietat i/o la decisió de revertir al règim de treball presencial; i finalment, el tercer apartat estableix el règim jurídic de la reversibilitat del treball a distància.

[eng] The purpose of this chapter is the voluntary and reversible nature of remote work, both for the employer and the employee. The matter is initially regulated in Article 5 of Royal Decree-Law 28/2020, of September 22, on remote work. Its first section outlines the terms of this voluntariness; the second aims to safeguard the exercise of voluntariness and/or the decision to revert to the on-site work regime; and the third, finally, establishes the legal framework for the reversible nature of remote work itself.
