Salario mínimo, igualdad salarial y protección del salario [Preprint]

Abstract

[spa] El presente estudio tiene como objetivo determinar la influencia del Derecho comunitario en la regulación nacional de una condición de trabajo tan esencial como es el salario. A tal efecto, se va a tener en cuenta también la normativa internacional precedente al propio Derecho comunitario. Tres son las cuestiones que se van a abordar: el salario mínimo, la igualdad salarial y la protección del salario. En cada una de ellas se analizarán las principales medidas exigidas por la UE y si nuestro ordenamiento cumple o no con las previsiones comunitarias.

[eng] The aim of this study is to determine the influence of community Law on the national regulation of such an essential working condition as wages. To this end, the international regulations that precede community Law itself will also be taken into account. There are three issues to be addressed: the minimum wage, equal pay and wage protection. In each of them, the main measures required by the EU and whether or not our legal system complies with community provisions will be analysed.
